If you are an Australian employer who needs to fill skill shortages in your business, you may be able to sponsor skilled workers from overseas under the standard business sponsorship (SBS) program. This program allows you to sponsor foreign nationals to work in highly skilled occupations for up to four years, or up to five years if they are in a regional area.
To sponsor skilled workers under the SBS program, you need to meet the following requirements:
=>You must be a lawfully operating business in Australia
=>You must demonstrate that you have a genuine need for the skilled worker and that the position cannot be filled locally
=>You must pay the skilled worker at least the market salary rate and provide them with the same terms and conditions as Australian workers
=>You must comply with the sponsorship obligations, such as cooperating with the Department of Home Affairs, keeping records, and notifying any changes
=>You must pay the relevant fees and charges, such as the nomination fee, the Skilling Australians Fund levy, and the visa application charge
The SBS program allows you to sponsor skilled workers under two visa subclasses:
=>Temporary Skill Shortage visa (subclass 482) (TSS): This visa allows you to sponsor skilled workers for up to four years, or up to six years if they are in a regional area and have an occupation on the Regional Occupation List. The TSS visa has three streams: the Short-term stream, the Medium-term stream, and the Labour Agreement stream. The stream you choose depends on the occupation, the skill level, and the duration of the sponsorship.
The SBS program offers Australian employers an excellent opportunity to bring in skilled workers from overseas to address skill gaps within their businesses. However, navigating the program can be challenging due to its complex and ever-evolving rules and regulations, which demand meticulous planning and compliance.
